Terms of Service

Please read these terms carefully before using Resurf.

License

Resurf is licensed software. Upon purchasing a license, you are granted a non-exclusive, non-transferable right to use the software on devices you own or control, subject to the terms below.

Your license is tied to a license key delivered at purchase. Activation requires an internet connection once to validate your key. After activation, Resurf works fully offline — your license is not revoked if our servers are unavailable. If you replace your Mac, you may deactivate your license and reactivate it on a new device.

Beta & Pre-release

Resurf is currently in beta. Beta software is provided for early access and may contain bugs, incomplete features, or unexpected behavior. We make no guarantees of stability during this period.

Features available in beta may be changed, removed, or replaced before or after stable release. This is not grounds for a refund if the core functionality of the app continues to work as described.

Permitted Use

  • Use Resurf for personal or commercial purposes
  • Install on multiple devices you personally own or control
  • Create backups of the software for archival purposes

Restrictions

  • Do not share, resell, or redistribute your license key
  • Do not reverse engineer, decompile, or disassemble the software
  • Do not remove or alter any proprietary notices or labels
  • Do not use the software for any unlawful purpose

Your Data

All data you create in Resurf remains yours. We do not claim any ownership or rights to your content.

Resurf is a local-first application. Your captures, notes, images, and all other content are stored exclusively on your Mac, in a vault folder you control. We have no access to your data and it is never uploaded to our servers.

Because your data lives entirely on your device, you are solely responsible for backing it up. We strongly recommend keeping regular backups using Time Machine or another backup solution. We are not liable for any data loss resulting from hardware failure, accidental deletion, corruption, or any other cause.

Third-party Services

Resurf integrates with or optionally uses the following third-party services, each governed by their own terms and privacy policies:

  • iCloud — optional sync via Apple's iCloud Drive. Subject to Apple's terms of service.
  • Sentry — crash reporting and error monitoring. No personal content is included in crash reports.
  • Polar — payment processing and license management. Purchase transactions are handled by Polar.
  • PostHog — anonymous usage analytics (if enabled). No personal data or content is collected. You can disable this in Settings at any time.

We are not responsible for the practices or content of these third-party services.

Disclaimer

Resurf is provided "as is" without warranty of any kind, express or implied. We make no guarantees regarding uptime, data integrity, or fitness for a particular purpose. To the maximum extent permitted by law, we are not liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use this software.

Refunds

We offer a 14-day refund policy from the date of purchase. If you are not satisfied with Resurf, contact us at support@resurf.so for a full refund.

Updates & Continuity

All beta updates are included at no additional cost. No specific updates are promised after stable release. However, if and when updates are released, Early Supporter licenses receive them free for 2 years from the date of stable release. After this period, you may continue using the version you have indefinitely — your license does not expire and the app does not stop working.

In the event that Resurf is discontinued, the software will continue to function as-is on your Mac for as long as macOS supports it. Because your data is stored locally in an open folder structure, you will always be able to access and export your content regardless of the app's status.

Changes to Terms

We may update these terms from time to time. Continued use of Resurf after changes constitutes acceptance of the new terms.

Governing Law

These terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these terms or your use of Resurf shall be subject to the exclusive jurisdiction of the courts located in Quebec, Canada. If any provision of these terms is found unenforceable, the remaining provisions will continue in full force.
